Agreement to Terms

By accessing or using the photography services provided by Comforteoscent ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Photography Services

Service Description

We provide professional photography services including private events photography, document photo sessions, and portrait & personal branding photography. Services are provided in accordance with the specifications agreed upon during consultation.

Service Scope

The scope of services, deliverables, timeline, and pricing are established through consultation and confirmed in writing before the commencement of photography sessions. Any changes to the agreed scope may result in adjustments to pricing or timeline.

Client Responsibilities

Clients are responsible for:

  • Providing accurate information about service requirements
  • Ensuring access to locations and necessary permissions for photography
  • Coordinating with subjects and participants as needed
  • Making timely payments as agreed
  • Complying with any venue or location-specific requirements

Payment Terms

Payment terms are established during the consultation process. Standard terms may include:

  • Deposit required to secure booking
  • Remaining balance due before or upon delivery of final images
  • Payment methods accepted as specified
  • Late payment fees may apply as outlined in the service agreement

Intellectual Property

Photographer's Rights

All photographs created by Comforteoscent remain the intellectual property of the photographer unless otherwise agreed in writing. The photographer retains the right to use images for portfolio, marketing, and promotional purposes unless specifically restricted by the client.

Client Usage Rights

Clients receive usage rights as specified in the service agreement. Standard agreements include personal and professional use rights. Commercial or editorial licensing may be available for additional fees.

Image Delivery

Images are delivered in the formats and within the timeline agreed upon during consultation. Standard delivery methods include secure online transfer. Physical delivery options are available upon request.

Clients are responsible for downloading and backing up delivered files. We recommend maintaining backup copies of all delivered images.

Revisions and Additional Services

Basic color correction and processing are included in standard service packages. Additional editing, retouching, or creative services beyond the original scope may be available for additional fees.

Revision requests are accommodated within the scope of the original agreement. Requests for significant changes or additional work may require separate arrangements.

Cancellation and Rescheduling

Cancellation and rescheduling policies are established during booking. Standard policies may include:

  • Deposits may be non-refundable depending on cancellation timing
  • Rescheduling requests should be made with reasonable advance notice
  • Last-minute cancellations may result in forfeiture of deposit

Limitation of Liability

While we take reasonable care in providing photography services, we are not liable for:

  • Unforeseen circumstances beyond our control
  • Equipment failure despite backup measures
  • Client or subject non-appearance or delays
  • Venue restrictions or access issues

Our liability is limited to the value of the service provided.

Force Majeure

We are not liable for delays or failures in performance resulting from circumstances beyond reasonable control, including natural disasters, government actions, or other force majeure events.

Image Usage and Licensing

Unless otherwise specified in writing, clients receive usage rights for personal and professional purposes. Commercial use, resale, or redistribution of images requires separate licensing agreements.

Photographer retains copyright to all images unless explicitly transferred in writing. Images may be used by the photographer for portfolio, marketing, and promotional purposes unless restricted by the client.

Client Responsibilities

  • Ensuring all subjects have provided necessary consents for photography
  • Coordinating access to locations and obtaining required permissions
  • Making timely payments according to agreed terms
  • Complying with venue rules and regulations

Service Modifications

We reserve the right to modify service offerings, pricing, or terms with reasonable notice. Existing bookings will be honored under the terms agreed at the time of booking unless mutually agreed otherwise.

Dispute Resolution

Any disputes arising from these terms or our services should be addressed through direct communication. We are committed to resolving issues fairly and professionally.

If a dispute cannot be resolved through direct communication, parties agree to attempt mediation before pursuing legal action. Mediation will be conducted by a mutually agreed-upon mediator.

Governing Law

These Terms of Service are governed by the laws of the jurisdiction in which Comforteoscent operates. Any legal proceedings will be conducted in the appropriate courts of that jurisdiction.

Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective upon posting to this page. Continued use of our services after changes constitutes acceptance of the modified terms.

Material changes to terms affecting existing bookings will be communicated directly to affected clients.
